01Agreement

Create & Cultivate (“we,” “us,” or “our”) is a nonprofit organization recognized as tax-exempt under Section 501(c)(3) of the Internal Revenue Code, EIN 88-1557753, with its principal mailing address at 2413 Kittyhawk Dr, Plano, TX 75025-6093.

By using our site or attending our events, you agree to these terms. If you do not agree, please do not use the site.

02Eligibility

You must be at least 18 years old, or the age of majority where you live, to register for events, donate, or subscribe.

03Acceptable use

You agree not to:

  • Use the site for any unlawful purpose or in violation of these terms.
  • Attempt to gain unauthorized access to any part of the site or its systems.
  • Scrape, harvest, or systematically extract data from the site without written permission.
  • Interfere with the operation of the site, including by introducing malicious code.
  • Impersonate any person or misrepresent your affiliation with any person or organization.
  • Resell or commercially exploit event tickets except as we expressly permit.

04Our intellectual property

The site and its contents — including text, graphics, logos, photographs, audio, and the Create & Cultivate name and marks — are owned by us or our licensors and are protected by intellectual property law. You may view and share our content for personal, non-commercial purposes with attribution. All other use requires our written permission.

05Content you provide

If you submit content to us — an application, a testimonial, a photo, or a message — you keep ownership of it, and you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display it in connection with our charitable mission and programs. You confirm you have the right to grant that licence.

06Third-party links

Our site links to third-party websites, including podcast platforms, ticketing providers, and press coverage. We do not control those sites and are not responsible for their content, policies, or practices.

07Events and tickets

Event attendance is also governed by our Ticket, Registration & Refund Policy, our Event & Community Code of Conduct, and our Photo, Video & Media Release. Programs, speakers, dates, and venues may change.

08Disclaimer of warranties

The site and our content are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free.

09Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the site, our content, or our events. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim arose.

10Indemnification

You agree to indemnify and hold harmless the organization, its directors, officers, employees, and volunteers from claims arising out of your use of the site, your content, or your breach of these terms.

11Governing law and disputes

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. You agree that the state and federal courts located in Collin County, Texas have exclusive jurisdiction over any dispute.

TODO(legal): decide whether to add binding arbitration and a class-action waiver, and have counsel draft that clause if so.

12Severability and changes

If any provision is found unenforceable, the rest remains in effect. We may update these terms; continued use of the site after changes take effect means you accept the revised terms.
