01Our position

Create & Cultivate (“we,” “us,” or “our”) is a nonprofit organization recognized as tax-exempt under Section 501(c)(3) of the Internal Revenue Code, EIN 88-1557753, with its principal mailing address at 2413 Kittyhawk Dr, Plano, TX 75025-6093.

We respect intellectual property rights and expect our community to do the same. We respond to valid notices under the Digital Millennium Copyright Act.

02Submitting a takedown notice

If you believe material on our site infringes your copyright, send a written notice to our designated agent that includes all of the following:

• A physical or electronic signature of the copyright owner or a person authorized to act for them.
• Identification of the copyrighted work claimed to have been infringed.
• Identification of the material claimed to be infringing, with enough detail for us to locate it.
• Your contact information — address, telephone number, and email address.
• A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
• A statement that the information in the notice is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the owner.

04How we respond

On receiving a valid notice we will remove or disable access to the material and make a good-faith effort to notify the person who posted it.

05Counter-notice

If you believe material was removed by mistake or misidentification, you may send a counter-notice including your signature, identification of the removed material and where it appeared, a statement under penalty of perjury that the removal was a mistake or misidentification, your contact details, and consent to the jurisdiction of the federal district court for your address.

06Repeat infringers

We terminate the accounts and access of people who repeatedly infringe copyright, in appropriate circumstances.

07Misrepresentation

Knowingly making a material misrepresentation in a notice or counter-notice can expose you to liability for damages under federal law.
